+ El Poder Legislativo deberá garantizar la inclusión en su plantilla laboral, de personas con discapacidad como trabajadores de confianza.
En la sesión ordinaria de este martes, las diputadas y diputados del H. Congreso del Estado de Colima aprobaron diversas modificaciones a la Ley para la Inclusión de las Personas con Discapacidad del Estado de Colima, con el objetivo de garantizar el impulso de la inserción laboral, así como una mayor incidencia del Poder Ejecutivo en acciones que fomenten el bienestar de este sector de la población.
Cabe mencionar que los legisladores José de Jesús Dueñas García y Rigoberto García negrete, integrantes del grupo parlamentario del Partido Revolucionario Institucional fueron los iniciadores de la iniciativa.
El dictamen expuesto en tribuna por la diputada Evangelina Bustamante, y elaborado conjuntamente por las comisiones de Estudios Legislativos y Puntos Constitucionales, así como de Bienestar, Inclusión Social y Equidad de Género, reforma la nomenclatura de la Ley para la Inclusión de las Personas con Discapacidad del Estado de Colima para denominarse Ley para la Inclusión e Integración de las Personas con Discapacidad del Estado de Colima.
Así mismo, plantea las modificaciones de los artículos 8 Bis fracciones XI y XII, 14 fracción I, 14 Bis, 15 fracción IV, 34 y 35; y adiciona el párrafo segundo al artículo 1, las fracciones V y XXXIV al artículo 2, haciéndose el corrimiento respectivo de las subsecuentes fracciones del mismo artículo 2, las fracciones XIII y XIV al artículo 8 Bis y el artículo 10 Bis, de la Ley referida.
Las modificaciones señaladas tienen como objetivo promover que estos sectores sean atendidos y protegidos con la debida sensibilización por parte de cualquier organismo público y privado o por la sociedad en general, evitando siempre las barreras actitudinales que generen rechazo o violencia hacia las personas con discapacidad.
Además, en el artículo 10 Bis, se establece que el Poder Legislativo deberá garantizar la inclusión en su plantilla laboral, de personas con discapacidad como trabajadores de confianza.
Por otro lado, la reforma especifica que el Consejo Consultivo del Instituto Colimense de la Discapacidad (Incodis) deberá ser presidido por la persona titular del instituto, o quien funja como presidente de la Comisión de Bienestar e Inclusión Social del Congreso del Estado.
Dicho consejo tendrá entre sus funciones: coadyuvar en acciones específicas de concertación, coordinación, planeación, promoción, seguimiento y cuidado de las acciones que permitan garantizar condiciones favorables a las personas que enfrentan algún tipo de discapacidad, fungiendo como observador del cumplimiento de esta Ley, exigiendo siempre la sensibilización hacia las personas con discapacidad y deberá denunciar ante las autoridades correspondientes cualquier incumplimiento.
La propuesta fue aprobada por unanimidad, por lo que el Poder Ejecutivo del Estado, dentro de los 180 días naturales siguientes a la entrada en vigor del presente Decreto, deberá realizar las adecuaciones al reglamentarias correspondientes.
