En sesión ordinaria, el Pleno del Congreso del Estado aprobó un dictamen mediante el que se reforman diversas disposiciones de la Constitución Política del Estado, en materia de amnistía, sustitución de regidurías y concejales municipales, así como la armonización con otras leyes.
El dictamen expuesto por la diputada Ana Karen Hernández Aceves, elaborado por la Comisión de Estudios Legislativos y Puntos Constitucionales, engloba dos iniciativas presentadas por las legisladoras de Morena, Viridiana Valencia Vargas y Sonia Hernández Cayetano, y reforma los artículos 31, párrafo quinto, 34, fracciones XXVII y XXXIII, 95, párrafo segundo y 90, fracción I, párrafo décimo tercero, de la Constitución Política del Estado Libre y Soberano de Colima.
La fracción XXXIII establece el conceder amnistía por delitos cuyo conocimiento corresponda a la jurisdicción de los tribunales del Estado. En ese sentido, dentro de los transitorios, el decreto aprobado estipula que, dentro de los 180 días naturales posteriores a la entrada en vigor, el Congreso del Estado de Colima deberá emitir la Ley relativa a regular el procedimiento para conceder amnistía por delitos cuyo conocimiento corresponda a la jurisdicción de los Tribunales del Estado.
Al respecto, la diputada Viridiana Valencia expresó en tribuna que “hoy avanzamos, en sintonía con la federación, en un paso hacia la justicia y la reinserción social de mujeres que han sido injustamente privadas de la libertad por haber decidido interrumpir su embarazo antes de que fuese despenalizado el aborto, de personas que han sido injustamente privadas de la libertad por haber robado un pan para que comieran sus hijos, de personas provenientes de pueblos y comunidades indígenas que han sido privadas de la libertad por defender su territorio, con un proceso judicial llevado a cabo sin traductores en la lengua natal de quienes son acusados o acusadas”.
Así mismo, sostuvo que, a quienes pretende beneficiar la amnistía, es a los más desfavorecidos, a quienes, sin uso de violencia, hayan incurrido en alguna conducta que se tipifica como un delito no grave, y que el estado y la sociedad tienen la obligación, la responsabilidad de buscar alternativas y que no la única solución posible, la única imaginada, sea privar de la libertad a las personas que sufren condiciones de marginación y de exclusión estructural.
En caso del artículo 31, la reforma establece la armonización de los funcionarios que glosan del Informe de Gobierno del Poder Ejecutivo, para que la persona titular de la Fiscalía General del Estado, al constituirse en un órgano estatal autónomo, ya no tenga la obligación de ampliar el informe del Poder Ejecutivo Estatal, al que ya no pertenece. No obstante, presentará anualmente a los poderes Legislativo y Ejecutivo un informe de actividades, y deberá comparecer ante cualquiera de ellos cuando se le cite a rendir cuentas o a informar sobre su gestión.
La reforma al artículo 34 en su fracción XXVII, armoniza el término de “Secretaría General”, que sustituye a “Oficialía Mayor”, para el Congreso del Estado.
Por otro lado, la reforma al artículo 90, en su fracción primera, párrafo décimo tercero, estipula que “si alguno de los miembros del cabildo deja de desempeñar su cargo por cualquier causa, será sustituido por su suplente y, en caso de impedimento o falta absoluta de éste, el Cabildo designará por mayoría calificada a quien cubrirá la vacante entre las y los restantes suplentes, correspondientes a las demás fórmulas asignadas al partido político de que se trate, quien deberá ser del mismo género de a quien sustituye. En el caso de las regidurías de representación proporcional la vacante se cubrirá conforme al procedimiento establecido en la legislación de la materia. En caso de la falta absoluta de algún miembro del Concejo Municipal, el Congreso, atendiendo a lo previsto en este artículo y la ley, deberá elegir a quien lo sustituya, garantizando que la persona sea del mismo género”.
Además, el caso específico de los municipios del Estado, existe una disposición expresa en el texto de la Constitución Política del Estado Libre y Soberano de Colima que señala un plazo diferente al establecido en el recientemente reformado artículo 36, para la entrega de las cuentas públicas anuales de los municipios. Por lo tanto, se reforma el artículo 95 en su párrafo segundo para establecer que los municipios “presentarán al Congreso su cuenta pública anual, conjuntamente con el dictamen de revisión de los resultados correspondientes, aprobado por el Cabildo, a más tardar el último día de abril del año siguiente al que corresponda la cuenta pública anual, para los efectos del artículo 36 de esta Constitución”.
El Decreto aprobado entrará en vigor al día siguiente de su publicación en el Periódico Oficial “El Estado de Colima”.
