INDIRA ANUNCIA DEMANDA DE NULIDAD CONTRA LA CONCESIÓN DE LIBRAMIENTO COLIMA¨

La gobernadora Indira Vizcaíno Silva, acompañada del consejero jurídico Roberto Rubio Torres, informó que su administración presenta demanda de nulidad contra la concesión de Libramiento Colima, por vicios legales y ser lesiva a los intereses de las y los colimenses, lo anterior en la conferencia de prensa Diálogos por la Transformación; “hemos tomado una determinación jurídica que es relevante para el erario y el interés de todas las personas interesadas en el desarrollo económico de Colima, la región y del país”, dijo la mandataria, quien dijo que este procedimiento se inició este mismo mes.

Recordó que la administración pasada anunció el proyecto del nuevo Libramiento Colima; “compartimos la necesidad de sacar el transporte de carga del libramiento Ejército Mexicano que, ante el crecimiento de la mancha urbana, hoy atraviesa la ciudad; pero no compartimos ni aceptamos que este proyecto se haga a través de un esquema ilegal, que si es exitoso las ganancias sean para un privado, pero si fracasa, los riesgos y los costos que llegarían a ser multimillonarios, sean asumidos por completo por el erario”.

Vizcaíno Silva dijo que no tiene sentido que el Gobierno del Estado participe en un proyecto económico donde las ganancias sólo sean para privados y las pérdidas sean asumidas por las y los colimenses; sería un error, estupidez o corrupción; “no debemos, ni podemos, ni queremos ser parte de un proyecto que tiene claras ilegalidades desde su instrumentación”, subrayó.

La titular del Poder Ejecutivo aclaró que revisaron alternativas para ver si a través de alguna adenda que modificara lo pactado originalmente podría rescatarse este proyecto; no es nada contra la empresa, ni se rechaza el proyecto por ser iniciado en el gobierno antecesor. No se comparte la instrumentación jurídica que es lesiva a las y los colimenses; “después de meses de análisis, llegamos a la conclusión de que no podían revertirse los vicios de origen de ese proyecto, y que tenemos que buscar su nulidad”, dijo.

“Cuando pedimos al concesionario el proyecto ejecutivo para obtener la concesión o tras obtenerla, no tenían nada: sólo una simple impresión o pantallazo de Google Maps de un supuesto trazo tan ridículo y desconectado de la realidad, que partía por la mitad el Isenco Cuauhtémoc. No había trazo, derecho de vía, ni detalle del proyecto; y había condiciones contractuales en las que o se tenía el tráfico deseado por el concesionario, o Gobierno del Estado iba a compensar a los particulares con participaciones federales lo que ellos deseaban tener como ingresos de esta concesión, como garantía de ingresos”.

“Decidimos que o se hacen bien las cosas o no se hacen; nos referimos a hacerlas apegadas a la ley y cuidando los intereses de las y los colimenses”. Reiteró que no está contra el desarrollo económico ni de buscar alianzas para impulsar el desarrollo económico, buscaremos impulsar el desarrollo carretero del estado que es clave para aprovechar el potencial de Manzanillo, pero jamás aceptando que intereses privados estén encima de los intereses generales y los intereses públicos de las y los colimenses.

CÚMULO DE IRREGULARIDADES

Roberto Rubio explicó por qué desde la perspectiva de Consejería Jurídica era necesario presentar un juicio de lesividad para reclamar la nulidad de ese contrato de asociación público-privada y que a la par se otorgó una concesión y compartió los antecedentes para contextualizar el tema, que inició en 2020 se firmó un contrato de asociación en modalidad de auto-financiable para dicho libramiento, en una primera etapa de dos carriles y una segunda etapa a cuatro carriles.

Una de las primeras irregularidades advertidas, fue que la primera etapa contemplaba dos carriles, sin establecer fecha cuándo sería la ampliación a cuatro carriles (sólo decía que cuando el flujo lo ameritara), quedando al arbitrio del desarrollador; “en enero y marzo de 2021 se modificó el contrato, generando más cargas económicas y responsabilidades al gobierno, lo que significaba que no era ni autofinanciable.

Señaló que el monto del proyecto se estimó en mil 450 millones de pesos aproximadamente, que se supone que el pago sería la tarifa que usuarios de la autopista realizaran; no fue así porque en el contrato y sus modificatorios establecieron obligaciones al estado y sanciones pecuniarias por incumplimiento; se estipuló una línea de crédito contingente para asegurar con participaciones federales el pago en caso de no cumplirse el flujo vehicular y no tener ganancias estimadas por el desarrollador.

“Fue un crédito aprobado por el Congreso por hasta 65 millones de pesos mensuales revolventes; quiere decir que si en determinado mes existía incumplimiento; se podrían hacer efectivas hasta por 65 mdp y si el siguiente mes también no hubiera esa misma cantidad, se tendrían que estar utilizando las participaciones federales; no había nada de autosustentable ni autofinanciable”, aclaró Rubio, quien dijo que se demandó la nulidad por el cúmulo irregularidades advertidas en la adjudicación en condiciones desfavorables para el estado. Por esas razones se presentó este juicio de lesividad ante el Tribunal de Justicia Administrativa (TJA) y es a la autoridad que corresponderá determinar sobre la nulidad.
