CAMPO CUATRO: «NO FUE JUBILACIÓN»

Renunció el fiscal general de Justicia en el estado, Gabriel Verduzco, dejando pésimas cuentas de su desempeño: no logró incidir en bajar los niveles de inseguridad e impunidad en el estado. Este escenario de ajuste de cuentas que estamos viviendo, la ola de violencia que deja media docena de muertos cada semana, no se entendería sin la presencia de Verduzco Rodríguez en la Fiscalía.
Mas no por ello le faltaron defensores. Incluso en el gremio de abogados, donde hay un mayor conocimiento de las responsabilidades de un fiscal y capacidad para evaluar si la gestión de Verduzco estuvo a la altura para enfrentar los elevados niveles de delincuencia en la entidad, hubo quienes calificaron la salida del funcionario como un golpe político.
Verduzco informó que se retira por jubilación. Otras fuentes hablan de una enfermedad tan grave que le impide seguir al frente de la Fiscalía. Ciertamente hubo causas de salud y es verdad que como funcionario ministerial ya había cumplido sus años de servicio, pero los motivos reales son políticos y derivan de su deficiente desempeño. El contexto en el que se dio la renuncia de Verduzco es una crisis profunda de seguridad.
Ya habrá tiempo de evaluar su gestión como fiscal autónomo, sus actuaciones y sobre todo sus omisiones, pero es inevitable que cuando se cite el nefasto periodo gubernamental de José Ignacio Peralta Sánchez se mencionen los pobres resultados de quien fue su fiscal.
Insistimos, no se entiende la situación que priva en el estado sin el paso de Gabriel por el organismo. Lo removieron por sus evidentes fallos: se distinguió por ser un fiscal oficioso, selectivo de los asuntos que debía perseguir, muchas veces elegidos con sentido político. Y el momento más grotesco de su gestión fue el montaje que llevaron a cabo para encubrir los delitos ocurridos en la casa del entonces secretario de Turismo, donde murió un menor de edad.
La renuncia por jubilación es la salida más decorosa que encontraron. El fiscal sabía que no iba a poder frenar él solo las presiones federales, entre ellas las de la UIF (Unidad de Investigaciones Financieras), ni las del nuevo gobierno estatal para que resolviera las carpetas de investigación de los casos problemáticos ocurridos en el sexenio de Peralta al que sirvió.
Ante la grave situación financiera que, por sí misma, revela actos de corrupción y de peculado, se requería de una persona que pueda ir hasta el fondo. Y Gabriel Verduzco no podría hacerlo, simplemente por los nexos que tiene con Ignacio Peralta.
 
EL NUEVO FISCAL

El relevo en la FGE recayó en Bryant Alejandro García Ramírez, un profesional del Derecho muy cercano a la futura gobernadora. Como colaborador, la acompañó desde el Ayuntamiento hasta la delegación federal de la Secretaría de Bienestar. Pero un dato tan interesante como ese, es que Bryant es hijo de Gilberto García Nava, quien fuera procurador general de Justicia en el gobierno de Gustavo Vázquez Montes.
El dictamen de la Comisión de Justicia, Gobernación y Poderes del Congreso señala que lo propusieron “debido a su experiencia y preparación”. Y deja en claro que ocupará el cargo por un plazo de seis  años, contados a partir del 1° de noviembre de 2021 cuando rinda protesta ante el Poder Legislativo.
En voz de una diputada, la Legislatura reconoce que Bryant García “es un ciudadano colimense con arraigo en la entidad, profesionista en derecho conocido en el estado, con experiencia y probidad, quien se ha desempeñado leal y eficientemente en diversas actividades del sector público, académico y privado”. Al ser pública, su trayectoria constituye “hechos notorios”, “circunstancias que valoradas en su conjunto son indicativas de la solidez moral y profesional para el cargo al que se le propone”.
No es menor la encomienda que tiene Bryant, dada la situación en la que deja Gabriel al estado. Aunque la Fiscalía es nominalmente autónoma, a García Ramírez le ayudará tener la confianza de la gobernadora Vizcaíno y los compromisos de Indira de combatir la corrupción e, incluso, depurar al órgano público. Por todas estas razones, goza del total beneficio de la duda. Se entiende que aun cuando tiene vínculos familiares con la otra ala de la política estatal, podrá resistir esas presiones gracias a su cercana relación con Indira.
Ese vínculo con la futura gobernadora fue determinante para que el Congreso aprobara su nombramiento, entre una terna de cuya integración no se informó oficialmente más allá de una lista que circuló en redes sociales. El gobernador saliente simplemente cumplió la petición que le hicieron de proponerlo, no obstante estar nominando a su probable verdugo.
A medida que se acerque la entrada del nuevo fiscal, crecerá la agenda de asuntos que tendrá que desahogar. Basta con la denuncia que presentó el rector de la Universidad de Colima ante la Fiscalía General de Justicia en el Estado, la Fiscalía Anticorrupción y, próximamente, ante la Fiscalía General de la República.
 
POLÉMICA OCIOSA

La designación de Bryant García como nuevo fiscal generó una serie de polémicas ociosas en las redes sociales y, especialmente, en los círculos de abogados respecto a si suponía un acto anticipado de gobierno por parte de una titular del Ejecutivo que no rendirá protesta sino hasta el 1º de noviembre.
Otros mencionaron que el funcionario confirmado por el Congreso no cumplía los requisitos, ya que nació en Estados Unidos. Sin embargo, es colimense de nacimiento en acuerdo a los términos constitucionales que así lo reconocen por ser hijo de padres colimenses.
Y, en el colmo, alguien habló de nepotismo porque Bryant es ahijado de bodas de Indira Vizcaíno. Tema tan irrelevante como los anteriores, porque ninguno supone una objeción para la elegibilidad del nuevo fiscal.
Se entiende que el verdadero reparo es político y deriva de la cercanía de García Ramírez con la gobernadora electa.
 
NUEVA MAGISTRADA

En esa misma sesión de Congreso, la Legislatura que concluyó su gestión este jueves 30 de septiembre aprobó también los nombramientos de Vicente Reyna Pérez, como magistrado presidente del Tribunal de Arbitraje y Escalafón (TAE), y de Lilia Hernández Flores como magistrada propietaria del Supremo Tribunal de Justicia del Poder Judicial del Estado de Colima (STJE).
Lilia Hernández ocupa la ponencia que dejó vacante Mario de la Madrid Andrade, al renunciar para asumir la titularidad de la notaría pública que ocupó su padre hasta su lamentable fallecimiento.
El dilema de Mario de la Madrid al optar entre dejar el Poder Judicial para concentrarse en el ejercicio notarial, lo tendrá en su momento otro magistrado, Sergio Marcelino Bravo, pero no es sólo una decisión personal. Estas situaciones apuntalan la exigencia social de hacer una reforma a la Ley del Notariado que actualmente garantiza los derechos sucesorios de los adscritos, para evitar que se repitan los casos de duplicidad de funciones que, por cierto, nada más se dan en Colima. En otros estados, los fedatarios públicos que asumen una responsabilidad pública distinta se ven incluso obligados a cerrar temporalmente su notaría.
El nombramiento de la magistrada Lilia Hernández fue saludado por las barras y colegios de abogados, ya que se trata del reconocimiento a una carrera judicial. La promoción de una juez es algo que no se vio en los nombramientos de los magistrados que se hicieron en el sexenio de Ignacio Peralta, los cuales incluso fueron impugnados.
Probablemente concertado con la mandataria electa, el nombramiento de Hernández Flores generó de inmediato una especulación respecto al futuro de la nueva magistrada. No es remoto que, en reconocimiento al acento femenino que tendrán las instituciones públicas, la futura presidencia del STJE recaiga en una mujer.
Con Viridiana Valencia como líder de la mayoría parlamentaria, podría repetirse eventualmente el cuadro que se dio en el sexenio de Griselda Álvarez, cuando la titularidad de los tres poderes del estado la ostentaron mujeres.
 
TRIBUNAL UNITARIO

Menos terso fue el arribo de Vicente Reyna Pérez al TAE. El Sindicato de Trabajadores al Servicio del Gobierno del Estado (STSGE) está en pie de lucha no tanto por el nombramiento del presidente sino por los cambios en la estructura del Tribunal, que tras aprobarse la reforma dejará de ser colegiado de cinco magistrados para convertirse en unitario.
Como esta reforma supone la desaparición de los dos magistrados que defendían de oficio a los trabajadores, el STSGE elevó el tono de la lucha hasta incurrir en lo que algunos medios describieron como “el secuestro de los diputados”, que en realidad fue la toma del Palacio Legislativo y el posterior bloqueo de la sede alterna. El acoso a los legisladores llegó al extremo de convertir al parlamento en un Congreso itinerante.
Finalmente, la reforma fue aprobada por unanimidad y, según la diputada Claudia Aguirre, servirá para profesionalizar al organismo y terminar con el rezago de expedientes en el TAE. Pero, sin duda, “el albazo” como lo llamó Martín Flores, dirigente de los burócratas, modificará la agenda de las negociaciones que buscará iniciar el STSG con el nuevo gobierno.
